This online store is operated by Designs by Danna™.
Throughout the store, the terms “we,” “us,” and “our” refer to Designs by Danna™. By accessing the store, submitting information, or purchasing a product, you agree to these Terms of Service and the policies made available through the store.
Do not use the store or purchase products if you do not agree to these terms.
Store eligibility and customer information
You must be legally capable of entering into a binding transaction in your jurisdiction or have the permission of a parent or legal guardian.
You agree to provide current, complete, and accurate order, payment, contact, and shipping information.
Products and availability
Designs by Danna™ makes reasonable efforts to display product descriptions, colors, images, dimensions, and availability accurately.
Colors may appear differently because of screen settings. Handmade, decorated, or individually produced merchandise may have minor variations that do not constitute defects.
Products and quantities may be limited and may be changed, withdrawn, or discontinued before an order is accepted.
Orders and payment
Orders require payment through the methods offered during checkout.
Submitting an order does not require Designs by Danna™ to accept or fulfill it. We may decline, limit, or cancel an order because of:
- Inventory discrepancies
- Payment problems
- Suspected fraud
- Incorrect pricing or listing information
- Shipping restrictions
- Customer-provided content concerns
- Technical errors
- Other legitimate business reasons
If Designs by Danna™ cancels an order after payment has been captured, the applicable refund will be issued to the original payment method.
Pricing, shipping, and taxes
Prices are shown in U.S. dollars unless otherwise stated.
Applicable shipping charges and sales taxes are calculated or displayed during checkout. Designs by Danna™ may correct an obvious pricing, tax, shipping, or listing error before fulfilling the affected order.
Custom and personalized products
Customers are responsible for reviewing submitted or approved names, dates, spelling, colors, sizes, quantities, artwork details, and other personalization information.
Custom, personalized, and made-to-order products are generally final sale except when they arrive damaged, defective, or incorrect because of a Designs by Danna™ error, as explained in the Refund Policy.
Customer-provided content
By submitting names, wording, photographs, logos, graphics, or other material for customization, you represent that you have the legal right and permission to use that material.
You authorize Designs by Danna™ to use submitted material only as reasonably necessary to review, produce, communicate about, and fulfill the order.
Designs by Danna™ may reject material that appears unlawful, infringing, fraudulent, hateful, threatening, obscene, deceptive, or otherwise inappropriate.
Intellectual property
Designs by Danna™ names, original artwork, product designs, photographs, written content, graphics, logos, and other store materials may not be copied, reproduced, resold, distributed, or commercially used without written permission, except where the underlying material belongs to another rights holder.
Purchasing a physical product does not transfer ownership of the associated artwork, design, trademark, copyright, production file, or other intellectual property.
Shipping, cancellations, returns, and refunds
Shipping, order delays, cancellations, returns, exchanges, and refunds are governed by the Shipping Policy and Refund Policy displayed through the store.
Prohibited use
You may not use the store:
- For unlawful, fraudulent, or deceptive activity
- To violate intellectual-property or privacy rights
- To submit false information
- To interfere with store security or operation
- To transmit malicious software
- To attempt unauthorized access
- To harass, threaten, or harm another person
- For any purpose prohibited by applicable law
Third-party services and links
The store may use or link to third-party services, including Shopify, payment processors, shipping carriers, social platforms, and other service providers.
Third-party services are governed by their own terms and policies. Designs by Danna™ is not responsible for third-party websites or services outside our reasonable control.
Disclaimer
To the extent permitted by law, the store and its content are provided without warranties other than those expressly stated.
Nothing in these terms excludes product obligations or consumer rights that cannot legally be excluded.
Limitation of liability
To the extent permitted by applicable law, Designs by Danna™ will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the store, delayed delivery, third-party services, or use of a product.
Any liability that cannot legally be excluded remains subject to applicable law.
Indemnification
You agree to be responsible for claims, losses, or expenses resulting from your unlawful use of the store, your violation of these terms, or your submission of content that infringes another person’s rights.
Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Entire agreement
These Terms of Service and the policies linked through the store constitute the agreement governing use of the store and purchases from Designs by Danna™.
Governing law
These terms are governed by applicable United States law and the laws of the State of Georgia, without overriding any mandatory consumer protection that applies to the customer.
Changes
Designs by Danna™ may update these terms by posting a revised version through the store. The version displayed when an order is placed will govern that transaction unless applicable law requires otherwise.
